These Mobile Terms and Conditions (“Messaging Terms”) describe the terms and conditions governing the mobile messaging program operated by Alinea Invest, Inc. (the “Alinea”, “we”, “us”, “our”) (the “Program”). By opting in to the Program, you accept and agree to these Messaging Terms.
By participating in the Program, you acknowledge and agree that you will receive communications from Alinea, and our affiliates, service providers, and representatives on our behalf (“Senders) via recurring automated promotional and personalized marketing text (e.g., SMS, MMS, and RCS) messages (“Messages”), including messages that may be sent using an automatic telephone dialing system(“autodialer”) or other automated system for the selection or dialing of numbers, at any time of day or night, to the phone number associated with your opt-in. Messages may include but are not limited to marketing, informational, transactional, operational and customer service communications concerning products and services, your account, payments, and/or use of Alinea’s website or application. YOU AGREE THAT MESSAGES MAY BE SENT USING AN AUTOMATIC TELEPHONE DIALING SYSTEM OR OTHER AUTOMATED SYSTEM FOR THE SELECTION AND DIALING OF TELEPHONE NUMBERS. Message frequency will vary and you agree to receive Messages at any time at our discretion. You agree that carrier message and data rates may apply to any Messages you receive in accordance with your carrier rate plan. YOUR CONSENT TO RECEIVE AUTODIALED PROMOTIONAL TEXT MESSAGES IS NOT REQUIRED AS A CONDITION OF ANY PURCHASE OR REGISTERING AN ACCOUNT WITH ALINEA. Nothing herein is intended to be interpreted to suggest or imply that any or all of Senders’ mobile messages are sent using an autodialer.
We reserve the right to modify these Messaging Terms and the Program at all times in our sole discretion. Such modifications shall be effective upon posting. In the event of a material change to these Messaging Terms, we will communicate such change to you. You acknowledge you are responsible for reviewing these Messaging Terms from time to time to ensure you are aware of any modifications. By continuing to participate in the Program after such modifications are posted, you accept and agree to those modifications.
1. Your Opt-In: You agree that the phone number you provided in connection with your opt-in to the Program is a valid mobile phone number owned by you or for which you are an authorized user. You agree to promptly notify us at info@alinea-invest.com in the event you no longer own or are an authorized user for the provided phone number.
2. Opting-Out of Program: You may opt-out of the Program at any time. To opt-out of Messages, you can reply with the words “STOP”, “QUIT,” “END,” REVOKE”, “OPT OUT,” “CANCEL,” or “UNSUBSCRIBE” to any Message you receive from Sender.
You acknowledge that you may receive further Messages for a short period of time while we process your opt-out request. In addition, you may also receive a one-time Message confirming your decision to opt out. To the maximum extent permitted by law, you acknowledge and agree that the foregoing options are the only reasonable methods of opting out.
You acknowledge that Sender’s text message platform may not recognize and respond to unsubscribe requests that alter, change, or modify the STOP”, “QUIT,” “END,” REVOKE”, “OPT OUT,”“CANCEL,” or “UNSUBSCRIBE” keyword commands, such as the use of different spellings or the addition of other words or phrases to the command, and agree that no Sender will have any liability for failing to honor requests that may circumvent the automated opt-out processes described above. You agree that other methods of opting out, including, but not limited to, texting words other than those set forth above or verbally requesting one of our employees to remove you from our list, may not be deemed to be reasonable methods of opting out.
3. No Time of Day Restrictions: You agree that your consent to receive marketing text messages includes consent to the delivery of such messages 24 hours per day. To the fullest extent permitted by applicable law, your consent supersedes any state or federal law or regulation that might otherwise restrict the delivery of such messages to certain time periods and you waive any claims arising from such restrictions.
4. Disclaimers: The Program is offered on an “as-is” basis with no warranties whatsoever. We do not warrant or guarantee that the Program will be available at all times and in every area or that you will receive all Messages sent through the Program. Alinea shall not be responsible and disclaims all liability for any delays or failures to receive a Message. Additionally, mobile carriers are not liable for delayed or undelivered mobile messages, including Messages.
5. Requirements: Not all mobile carriers and phone providers provide the required services to participate in the Program. You must have a mobile device, capable of two-way messaging, with a participating carrier, and be subscribed to receive text messaging services in order to participate in the Program. You must be, and hereby represent and agree that you are, at least eighteen years of age (or the age of majority where you live if older).
6. Consent to Receipt of Electronic Information: You acknowledge and agree that communications between you and Alinea may take place via electronic means. You (a) consent to receive communications from Alinea in an electronic form; and (b) to the fullest extent permitted by applicable law, agree that all terms and conditions, agreements, notices, disclosures, and other communications that Alinea provides to you electronically satisfy any legal requirement that such communications would satisfy if it were to be in writing. You understand that you may withdraw this consent, update your information, or request a free paper copy of the information by emailing us at info@alinea-invest.com.
7. Comments; Questions: If you need support or have any questions in connection with the Program, please email Alinea at info@alinea-invest.com. Please note that the use of this email address is not an acceptable method of opting out of the Program.
8. Your residency: You agree that a Sender may assume that you are a resident of a particular state if the area code for the phone number used to opt-in to the Program is an area code associated with that state. Further, you agree that you will not assert that you are a resident of a state other than the state applicable to your area code unless you affirmatively advise us in writing that you are a resident of a specific state by sending written notice to us. You further agree that any mobile messages sent by Senders in direct response to mobile messages or requests from you (including but are not limited to response to keywords, opt-in, and help or stop requests) shall not constitute a “commercial telephone solicitation phone call”, “telephonic sales call”, “telemarketing sales call”, “telephone solicitation”, or “unsolicited telemarketing sales call” for purposes of U.S. federal and state laws, to the extent the law is otherwise relevant and applicable.
9. Participants Located in Texas: Insofar as Texas law applies to your receipt of one or more text messages, and for purposes of applying Texas Business & Commerce Code Sections 302.058 and 302.059, the parties agree to the following:
• The word “customer” shall be interpreted in a manner consistent with the broadest dictionary definition and common usage. Customer shall not be interpreted to require the purchase of a product or service.
• The word “establishment” shall be interpreted in a manner consistent with the broadest dictionary definition and common usage. Establishment shall not be interpreted to require the operation of a physical store, but rather shall include an online store.
10. Do Not Call Policy: Alinea’s policy is to not send any telemarketing Messages or direct telephone solicitations to:
• Any mobile telephone number, using an autodialer or other automated system for the selection or dialing of numbers, for which we do not have prior express consent to send or direct such communications; and
• Any telephone number on Alinea’s internal Do Not Call List.
Alinea maintains an internal Do Not Call List and will promptly honor, within a reasonable time of such request, any request it receives to stop marketing calls or texts, including opt-outs pursuant to Section 2 of these Messaging Terms or made via email to info@alinea-invest.com. Any telephone number covered by a Do Not Call request shall be retained on Alinea’s Do Not Call list indefinitely, until new prior express written consent is provided. If you change your phone number after making a Do Not Call request, you must request for the new phone number be added to Alinea’s Do Not Call list.
